Case Study - Personal Injury - Seniors Get Injured Too
Situation:
As Catherine* aged 80 was crossing at a pedestrian crossing, she was struck by a vehicle which knocked her down. Although the impact was light, her injuries were devastating. She was rushed to hospital by ambulance with fractures to both upper limbs. Complications resulted in a total elbow replacement for one arm.
Response:
Given the extent of her injuries, we were able to obtain an initial TAC impairment payment and then a further six figure payment (a total of $150,000.00) to compensate her for pain and suffering. The settlement took into account Catherine's statistical life expectancy, which was calculated at 9 years. By this stage she had returned home and was again living independently with the assistance of carers and her family.
Outcome:
This process was all negotiated with the TAC within 6 months of the accident date.
Catherine's ongoing medical and rehabilitation expenses as a consequence of her injuries will be paid for life by the TAC pursuant to the no fault provisions of the Transport Accident Act.
